Vic: 46 yo gets 6 years jail for manslaughter of defacto's son

A 46-year-old man who shot dead his defacto wife's teenage son was today jailed for
six years for manslaughter.

Supreme Court judge Justice GEOFF FLATMAN has ordered DAT TUAN NGUYEN to serve a minimum
non-parole term of four years.

After taking into account time already served, NGUYEN could be free in less than a year.

The jury acquitted NGUYEN of the murder of 14-year-old DUC DOAN TRAN, who died after
he was shot in the chest with a sawn-off shotgun at close range on June 27, 1998.

He was found guilty on the lesser charge of manslaughter.

It was the second trial he faced.

In the first trial, NGUYEN, formerly of Summerhill Road, Footscray was convicted of
murder and sentenced to 17 years with a minimum non-parole term of 12 years.

The conviction was later quashed on appeal and a new trial ordered.

Justice FLATMAN said he remained puzzled as to the reason NGUYEN had a shotgun in his
possession on the night of the killing.
